These Terms of Service govern the use of this website and the six loft services offered by Archibald of Aberdeen Limited from the Glenealy office. By reading the site, sending an enquiry or booking fiber, scouring or loom time, a client accepts these terms. The terms are written in plain English so that a buyer, a spinner and a weaver can each understand the same obligations without legal training.
Archibald of Aberdeen LimitedThese terms apply to every visit to fiberlugar.hair and to every order, reservation or booking made with Archibald of Aberdeen Limited. A person who uses the website or sends a booking enquiry confirms that they have read these terms and accept them.
Where a client signs a written booking schedule or a season contract, that document and these terms are read together. If a signed schedule states a term that differs from these terms, the signed schedule prevails for that booking only, and the rest of these terms continue to apply.
A client who does not accept these terms should not use the website or place a booking. The desk is happy to discuss a term before a booking is made, and a reasonable variation can be agreed in writing where the work allows it.
The company means Archibald of Aberdeen Limited at Rm 2A 17/F Glenealy Tower, 1 Glenealy, Central, Hong Kong - 999077, Hong Kong (HK). The loft means the fiber storage and preparation floor operated by the company. The client means the person or business that books a service or buys fiber. The booking means a written confirmation of fiber, scouring or loom time issued by the desk.
A lot means a quantity of fiber of one grade, identified by a lot number. A batch means a quantity of fiber washed together in a single scouring run. A strick means a tied bundle of long fiber. A hank means a short sample length of fiber prepared for handling. A schedule means the written document naming lot, batch and loom windows.
The company offers six services from the Glenealy office: fiber lot bays, scouring batch runs, loom booking desks, condition reviews, sample hanks windows and season contract sittings. Each service is described on the services page, and that description forms part of these terms.
The company is a supply desk and a preparation loft. It stores fiber, washes fiber and books loom capacity. It does not act as a grower, it does not own the looms it books and it does not take title to the cloth that a client weaves. Where a client wants a service that is not listed, the desk will say plainly whether the loft can perform it or not.
The company may subcontract a part of the work, such as a courier delivery or an additional drying run, but it remains responsible to the client for the service as a whole.
A booking exists only when the desk has issued a written confirmation naming the service, the grade, the volume, the price and the relevant dates. A verbal discussion, an email enquiry or a request for availability does not create a booking.
The desk aims to issue a confirmation within two working days of receiving a complete brief. A brief is complete when it names the grade, the volume and the deadline, and states whether scouring is required. An incomplete brief will be returned with a request for the missing details.
Once a confirmation is issued, the fiber and the loom window named in it are held for the client. A client who wishes to change a confirmed booking must follow the change procedure in section thirteen. The desk does not hold capacity without a confirmation, and a client should not assume that fiber is reserved until the written confirmation has arrived.
A fiber lot bay holds one grade of long fiber, weighed at intake and recorded on a bay card. A client may reserve a bay for a month or for a full season. The reservation means that the grade is held aside, inspected on a fixed cycle and not blended with later arrivals without written consent.
A storage fee applies to a reserved bay. The fee is credited against the first shipment from that bay. If a reservation is released early, the unused portion is credited against the closing weight recorded at release. Fiber that remains in a bay after the reservation period ends may be released back to general stock after fourteen days written notice.
The client is responsible for collecting reserved fiber within the period named in the confirmation. Where fiber is left in a bay beyond that period without a renewed reservation, a continued storage fee applies at the rate stated in the confirmation.
A scouring batch run washes fiber in warm water with a mild alkaline assistant, rinses it in staged tanks and dries it on racks. The batch size is set by grade and by the end use stated in the brief. Each batch receives a number and a moisture reading when it leaves the racks.
The moisture reading is part of the delivered result. If a batch sits outside the moisture window agreed in the confirmation, the company will either extend the drying period and re-read the batch, or re-scour the affected weight at no charge. The company will not dispatch a batch that fails its reading without telling the client in writing.
Weight may change during scouring, because the process removes pectin, wax and field dust. A loss of mass within the range stated in the confirmation is normal and is not a defect. The client is told the expected range before the batch begins, and the actual figure is recorded on the batch slip.
The loom booking desk assigns warp preparation, weaving windows and finishing slots in sequence. Loom time is capacity, not cloth. A booking for loom time guarantees the named windows to the client and guarantees payment of the booking fee to the operator of the loom.
The desk books warp preparation first, weaving second and finishing third. A request that reverses the order will be returned for correction, because finishing cannot be honestly scheduled before the cloth exists.
Loom time is held against the fiber lot named in the confirmation. If the client changes the lot, the desk will check whether the booked windows can still be met. Where a change of lot makes a window impossible, the desk will offer an alternative window before releasing the original booking.
The company is not responsible for the quality of cloth woven on a loom that it books. The weaver is responsible for the cloth, and the company is responsible for the accuracy of the booking and the condition of the fiber supplied to it.
A condition review is carried out before dispatch and records moisture, color drift, breakage and handling marks against the lot number. The review is performed from a fixed sheet so that two reviewers looking at the same lot produce comparable notes.
Where a review finds a fault, the client is told before the lot leaves the building, and a remedy is agreed in writing. A remedy may be a re-scour, a substitution from another bay, a reduction in price or a hold on dispatch until the client decides. The company will not send a faulty lot in the hope that the fault goes unnoticed.
A review is a check of the fiber at the time of dispatch. It is not a guarantee of how the fiber will behave under every possible draft, twist or finishing method. The client remains responsible for testing a grade against its own process, and the sample hanks window exists to support that testing.
Sample hanks are short lengths of each grade, hung in daylight for a buyer to handle. A sample window can be booked for a single visit or held open for a season. Held windows are refreshed when a new lot arrives so that the buyer is never handling stale stock.
A hank is a sample, not a promise of exact color match across a full lot. Natural fiber varies slightly from bale to bale. The company will show a hank from the actual lot named in the confirmation where the client asks, and will record which hank was shown and on which date.
Hanks taken away from the loft remain the property of the company until they are paid for at the sample rate stated in the confirmation. Hanks returned in good condition within thirty days are credited in full.
The season contract sitting fixes the calendar for the coming season. Growers, scourers, weavers and buyers meet with one shared document and agree volumes, grades and loom windows. The sitting is held once a year at a date published by the desk.
A plan produced at a sitting becomes binding on a party when that party has signed the plan and received a copy. A party who cannot attend may submit a written position, which is read into the record and treated as that party contribution.
A party that fails to meet an agreed volume without a valid reason may lose priority for the following season. The desk will discuss the shortfall at the next sitting before deciding on priority. A shortfall caused by a force majeure event described in section eighteen is not counted against the party.
Prices for each service are stated in the written confirmation. A price covers the work named in the confirmation and nothing more. A change that adds work, such as an extra drying run or a rescheduled loom window, will be quoted before it is carried out.
Unless the confirmation states otherwise, invoices are payable within thirty days of the invoice date. A late payment may attract interest at the rate stated in the confirmation. The company will not withhold a delivery over a disputed invoice where the disputed part is small and the undisputed part has been paid.
Payment is made by bank transfer to the account named on the invoice. The loft does not take payment through this website and does not accept card details by email. A client who receives a request to pay to a different account should verify it with the desk by telephone before transferring any money.
Delivery is arranged to the address named in the confirmation. The desk will state whether delivery is included in the price or quoted separately. A delivery date is a target agreed in good faith and may move where a courier or a customs inspection causes a delay outside the control of the company.
Risk in the fiber passes to the client when the consignment is handed to the courier, unless the confirmation states a different point. The client should inspect the consignment on arrival and record any visible damage on the delivery note before signing for it.
Where a consignment is lost or damaged in transit, the company will help the client pursue the courier claim and will not leave the client to manage the process alone. A replacement can be arranged from another bay where stock allows.
A client may cancel a booking by written notice to the desk. The charge for cancellation depends on how close the cancellation falls to the booked work.
A change to a confirmed booking is treated as a cancellation of the original item and a new booking of the replacement item. The desk will apply the cancellation rules to the original item and will quote the replacement at the standard rate unless the change is caused by a fault of the company.
Fiber is a natural material and varies from bale to bale. The company grades each lot against the sheet used at intake and reviews each lot before dispatch. A lot is supplied as described in the confirmation and in the condition review attached to it.
A client who believes that a lot does not match its description should tell the desk within fourteen days of delivery, keeping the lot number and a sample of the fiber concerned. The company will inspect the sample, compare it against the retained review note and answer in writing within seven days.
Where a claim is upheld, the company may re-scour the affected weight, replace it from another bay, reduce the price or refund the value of the affected weight. The remedy will be proportionate to the fault. The company does not accept a claim for loss of profit on cloth already woven from a lot that was inspected and accepted by the client.
A client agrees to give accurate information about the grade, volume and deadline required, and to tell the desk about any special condition that the fiber must meet, such as a dye requirement or a finishing method that affects drafting.
A client agrees to collect or accept delivery of reserved fiber within the period named in the confirmation, to pay invoices when due, and to keep the lot and batch numbers on file so that a later question can be traced.
A client agrees not to misuse the website, not to attempt to gain access to records that do not belong to the client, and not to use the contact form to send unlawful or abusive material. The desk may decline a booking from a client who behaves in that way.
The text, layout and code of this website belong to Archibald of Aberdeen Limited. A visitor may read the site, print a page for personal reference and quote a short passage with a clear credit to the company. A visitor may not copy the site in bulk, republish its pages as their own or use its design for a competing site without written permission.
The lot numbers, batch numbers and review sheets produced by the loft are records of the company. A client may use the records that concern the client own order, including sharing them with a bank, a customs broker or a professional adviser. A client may not publish the records of another party.
The names and marks of the company may not be used to suggest an endorsement of a product or a service that the company has not approved in writing.
The company is responsible for performing each service with reasonable skill and care and for the accuracy of the records it issues. The company is not responsible for indirect losses such as lost profit, lost production or lost contracts, except where the law does not permit that exclusion.
Where the company is liable for a fault in a service, the liability is limited to the value of the affected weight of fiber or the fee for the affected loom window, whichever is the smaller. The company will always first offer a remedy under section fourteen before a monetary settlement is considered.
Nothing in these terms limits the liability of the company for death, personal injury caused by negligence, or fraud. Nothing in these terms removes a right that a consumer holds under the law of the place where the consumer lives, where that law does not allow the right to be removed.
The company is not in breach of these terms where a delay or a failure is caused by an event beyond its reasonable control. Such events include a severe storm that closes the port, a fire or flood at the loft, a government restriction on transport, a failure of the public power supply that lasts beyond a working day, and a labour dispute that is not caused by the company.
The company will tell the affected client as soon as it can and will explain what part of the work is affected. Where an event lasts more than thirty days, either party may end the affected booking without a cancellation charge, and any payment for work not yet performed will be refunded.
The company will keep the fiber safe during such an event where it can, and will record the condition of any lot that has been affected so that the client can decide how to proceed.
Either party may end a booking under section thirteen, or under section eighteen where a force majeure event continues. The company may also end a booking immediately where a client gives false information about a grade or a delivery, fails to pay an overdue invoice after written reminder, or behaves abusively toward loft staff.
On termination, the company will account for fiber already stored, scoured or booked, will issue a final invoice for work performed, and will return any fiber that belongs to the client in the condition recorded at the last review. Any credit owed to the client will be paid within thirty days.
Termination does not affect a term that is intended to survive it, such as the retention of records, the limitation of liability and the governing law.
These terms are governed by the law of Hong Kong. A dispute that cannot be settled by discussion will be brought before the courts of Hong Kong, unless the law of the place where the client lives gives the client a right to bring the dispute locally, in which case that right is respected.
Before a formal step is taken, the parties will attempt to settle the dispute by written discussion through the booking desk. The desk will respond to a written dispute within seven working days and will propose a meeting where the facts can be reviewed against the lot and batch records.
The company reviews these terms once a year, at the season contract sitting, and at any time when a service changes. A change is published on this page with a new effective date at the top.
A change applies to a booking made after the new effective date. A booking already confirmed continues under the terms in force when it was confirmed, unless the client agrees in writing to the new version. The desk will send a copy of a revised term to an active client on request.
Questions about these terms, a request to vary a term before a booking, or a written dispute should be sent to the booking desk. The desk will answer within one working day for a question and within seven working days for a formal dispute.
